P.ul Clinton DAILY PILOT NEWPORT BEACH -In a survey of last year's beach postings and closures, the New- port Dunes Waterfront Resort shows up as one of a handful of Orange County's most troubled spots. The resort docked 15 separate postings during that calendar year. At least a part of the resort's lagoon was posted for 144 days of the year, or nearly 40% of the time. The report, issued by the National Resources Defense Council, also singled out 43rd Street beach, Harbor Marina and the 33rd Street Channel as other trouble spots. )Vaming signs were posted at those three areas· the entire year. During 2000, Newport Beach led the county in postings and closings with 73. Huntington Beach followed with 49. Third place went to Laguna Beach with 19. ·There's a problem,· said Defend the Bay founder Bob Caustin. •People don't reali7.e how often the beaches are closed in Newport.• Postings countywide jumped 75% from the year before to 8En during 2000. Three- quarters of the postings were caused by ele- vated bacteria levels from unknown sources, according to the report. When bacteria levels exceed the state's standards for appropriate levels, the Orange County Health Care Agency hammers warn- ing signs into the sand at the affected beach- es and recreation areas. At the Dunes on Thursday, children frol- icked in the water around a fake blue whale in the resort's swimming area. The sigllS nearby read: ·0cean water contact may cause illness. Although funding for both projects finally seems to be locked in, city offi- cials are working against a deadline - June 30, 2003 -at which time it will lose the federal money. Deepa Bharath DAILY PILOT LOS ANGELES -1\vo Toyota dealerships, including one in Costa Mesa, have agreed to reimburse more than $1 .9 million to customers who alleged the dealers engaged in misleading advertising and unfair sales practices, offidals said. The agreement was the result of a joint consumer pro- tection action againsi the South Coast Toyota dealer- abip in Costa Mela, u well u South Bay Tuyota in Gardena. Both decderships were sold Feb.6. The settlement calls for the former owners of the dealer- ships to pay ·$1.5 mllllon in restitution, $405,000 in penal- ties and $95,000 in costs. 1be defendants settled but have not admitted to the alleged violations. The case was investigated by the Orange County district attorney's Consumer Protec- tion Unit, the Los Angeles district attorney's o~ the state attorney general, the Department of Motor Vehi- cles and the Los Angeles eoupty Oepe.rtment of Con- sumer Affairs. Several custQmers also complained to officials that the dealerships engage<t in a "bait-and-switch" scheme in which the dealer aggressively attempts to switch consumers who respond to the advertise- ments to different, more expensive vehicles, which the dealer would sell at prices substantially above those advertised. The settlement agreement, filed Wednesday in Los Angeles Superior Court, remains to be approved by a judge. An All-American USC basketball player in the late 1950s, Rogers also has the distinction of serving as the first head basketball coach at UC Irvine.
